CAC; the story of two virgins.
CAC is the commission responsible for the registration and regulation of companies in Nigeria.

Two wise virgins were asked at what point will they flee an advancing rapist. The wise one answered once the hug extends beyond shoulder to chest. The other replied, once he advances towards my “South-South” the source of my monthly oil!

The above scenario depicts the situation most lawyers in CAC have found themselves. You are entitled to choose your class, but the stack truth, is, CAC is a menacing economic rapist on the rampage. Like a derailed train, services in CAC are improving from worse to worst and the RG obviously have no solution to these administrative problems. We don’t know if it is the case of a bad apprentice barber or a blunt blade; or a bad Fulani herdsman blaming his cow for malnutrition! But what we know is that, the RG has failed and should accept responsibility and apologize to all customers of CAC. He should be administratively wise to arrest the situation before it degenerates further. Buying one multi-purpose photocopier( at Customer desk) is not the panacea to the rotten availability generating, status/RC checking systems, the careless attitude to files in the filing room, (lawyers are most guilty) the corrupt and diversion of brief and under-charging by staff.

We may be ranting, but if you have to apologize to your client from Lagos , for failure to procure AV in one week, inability to file and dispatch Business name within two weeks, you will appreciate the passionate pains with which we lament this lackadaisical attitude of the RG and other administrative staff of CAC. Some lawyers we know, have formed a habit of refusing clients’ calls and the shameful ones, tell clients that names have been approved, only to “retell” the client after money has been paid into the lawyer’s account that the name was approved in error. This unethical practice, is aided by CAC staff, who tells a customer that a name has been approved in the system, only for the availability receipt to be printed NOTICE OF DENIAL.

Today 21st Day of February, CAC is at her best again. The systems ritualistically, have collapsed. This resounding echo of failure is sickening and the staff should be ashamed to tell customers this. This excuse is as worn out as the hinges of hell’s gate. They should come up with a smart excuse to rape us. I wonder if the Senate/House of Assembly Committee with an oversight function towards CAC bothers to see the rot in CAC. Or is there an expected annual return from CAC that makes these distinguished members of NASS to shy away from looking into CAC. I learnt that Charles Ugwu, the Commerce minister, has a date with the Senate, I pray one senator will be sober and fire the right questions. Further more, the time has come for decisive action. All lawyers, who feel it like we do, should stop causing the darkness and light the light of leadership, the light of way forward, which we dare opine, is a well crafted petition to the ministry of commerce, complaining of these pyramid of problems in CAC, which borders on failed leadership. This failure has robbed Nigeria of dare revenue. With the threat from MEND to remend NNPC pipelines over Henry Okah, all alternative sources of revenue to the federation should be jealously guarded like a woman protects her breast while doing a courtship race to meet her suitors!

If the RG and other directors are seeing vision of retirement benefits, they can fast forward it, windup and take an early exit, pave way for the emergence of a dynamic visionary team, that will transform CAC to an enviable height in Africa, if we can’t compete with America and EU states, after all, it is better to be a tadpole in a pond than a tilapia in a shark infested coven.

Since Lawyers do not go on strike for the interest of their client, we suggest that every lawyer whose sole jurisdiction is CAC, should be like the wise virgin and insist on quality service, as it is a common economic principle that the consumer is ever willing to pay high for a good product, service and timely delivery. If CAC works as at when due, we assure you, that clients will willingly pay 100K for Incorporation of 1million share capital company. Forget the miraculous instance of Babalola!

Some are called to be lawyers, obey the system, cause the darkness, but we are doomed to keep speaking, squealing, even if the RG is deaf and administratively blind to the problems in CAC. We no go tire, its our mandate to create and live in a better Nigeria , for a bad citizen of Nigeria will be a sore in Heaven/Paradise-be it America or in the hereafter.
